Because the FBI is investigating payday loan scams, bankruptcy attorneys may help payday loan recipients avoid being defrauded by the scam callers.

According to the AP, the FBI reported that some payday loan recipients are receiving threatening calls by callers fraudulently claiming to be from the FBI, other agencies, and law firms. These callers warn of legal consequences and demand repayments. The recipients of the loans are under the impression that it is the payday loan employees that are calling them while harassing them. Or they think that the government or law firm is pursuing legal remedies against them. Unfortunately, it is not too uncommon for payday loan recipients to receive threatening calls from creditors and so the tone of the payday loan scams are similar to the calls they are already receiving.

Payday loan companies may lend money for short periods of time to borrowers who use the small loan amounts to cover living expenses in between paydays. Recipients of payday loans may find it difficult repaying these loans because the interest rates can be high. Some payday loan recipients may take out additional payday loans merely to payback their original payday loans. However, some payday loan recipients choose to eliminate their payday loans by hiring attorneys if they feel they can no longer afford to payback the payday loans or if they feel that they no longer want to receive collection calls.

The payday loan scam callers have acquired accurate information about the payday loan recipients and repeatedly call them at their homes and threaten to arrest them. As a result, the FBI has requested that these recipients should notify their local law enforcement agencies, banks, and credit bureaus. However, recipients of payday loans can simply have a bankruptcy attorney review their case. Sometimes, the most direct remedy to avoid the payday loan scams is simply to file bankruptcy on the creditors.

Bankruptcy attorneys can help debtors eliminate debt through Chapter 7 and Chapter 13 bankruptcy filings. Once debtors file bankruptcy, they are given a bankruptcy case number and federal law prohibits creditors, including payday loan companies, from calling to collect money. The filings also stop all collection activities, including garnishments and lawsuits. A Chapter 7 bankruptcy, also known as a liquidation, enables debtors to wipe out debts and the procedure typically is finished within a few months. In contrast, a Chapter 13 bankruptcy, also known as a payment plan, enables debtors to make monthly payments to the bankruptcy court who then pays out creditors over a 3 to 5 year period.

If you are receiving harassing creditor calls, including from payday loan companies, make sure that your rights are not being violated or that you are being scammed by contacting us at bankruptcy lawyer

When times are tough financially, many people struggle and find out how it’s all too easy in a bad economy to fall into debt and not be able to make any payments as they fall further and further behind on all of their bills. Bankruptcy is something you want to avoid if at all possible, however the situation is serious to the point where the debt payments are too much and the home is in danger, then you’re probably well past the point of being helped by budgeting advice.

One good option is to arrange a meeting with a bankruptcy attorney. This specialist lawyer can help you by outlining your responsibilities, options and the legal obligations you have in the worst case scenario. If you decide to pursue this option, you should be sure to look into the different bankruptcy attorney niches – ensuring you have the right one for your specific situation.

Retaining a specialist bankruptcy lawyer is essential if you need your application handled correctly when filing for bankruptcy. It pays to contact the state bar association to find a specialized certified lawyer that can deal with your particular bankruptcy issue. For a solicitor to specialize in particular areas of bankruptcy law, they are required to undertake an examination in which they must demonstrate their competence in their specialization. Usually some form of further education is a pre-requisite for entering into this specialization.

When hiring a lawyer to handle your bankruptcy case, it is crucial to ensure you do so in plenty of time in order to assure that your case has sufficient time to be processed correctly. It is therefore important to seek a good lawyer early on to leave you plenty of time to review your situation and to establish your case.

A good attorney with solid bankruptcy knowledge should be prepared to provide you with full details of your options and alternatives to filing for bankruptcy if that is the way to go. Should you need to go ahead with filing your bankruptcy case, then the attorney should be able to assist you with everything you require and help you to understand everything you need and what you are obligated to do in order to file the case.

Finally, an important part of the bankruptcy process is that you must be sure that you can pay the legal fees and also cover all the necessary natural fees that come up throughout the process of actually going through with the bankruptcy. Make sure to do your research and while the price of your bankruptcy attorney is important, price isn’t everything. Make sure to talk to past clients or get recommendations from friends who had to go through bankruptcy before. Getting the right attorney for your case is extremely important, and getting a quality lawyer will definitely make the process easier for you.

Are you considering bankruptcy? Before you do, be advised that hiring the right bankruptcy attorney is critical. G. Michael Crowne, a prolific author in the legal field, will tell you about your options that are available before hiring a bankruptcy lawyer. Don’t miss what he has to say!

Bankruptcy will eliminate most of your unsecured debt. However, there are a few kinds of debt that one cannot have “discharged” (eliminated) in a bankruptcy. It is important to understand this as you make these important decisions. The bankruptcy rules explicitly list certain debts that you may have which are exempt from discharge in bankruptcy via Section 523(a) of the Bankruptcy Code.

In a Chapter 7 bankruptcy, you cannot eliminate:

Child support or alimony

Certain tax debts

Student loans

Luxury items worth more than $500 purchased within 90 days of filing bankruptcy

Government fines

Cash advances above $750 that were made within 70 days of filing bankruptcy

Debts that are deemed fraudulent

Damages that are a consequence from the willful or malicious or injury of another person

Condominium or home owner’s association fees

Personal injury or death from the operation of a vessel, vehicle, or aircraft

In some cases, debts that are not listed on your schedules

A debt that results from maliciousness or fraud is not exempt from a bankruptcy discharge automatically. The creditor must take action and request the court to specifically prevent the discharge of this type of debt. If the creditor does not do this, the debt will then be discharged.

In a Chapter 13 bankruptcy, you cannot eliminate:

Student loans

Government fines

Child support or alimony

Drunken driving judgments

Certain tax debts

Debts that result from compensation or fine from a criminal case

It may be possible to eliminate a debt that results from some type of intentional wrongdoing or fraud in a Chapter 13 bankruptcy. A creditor must file and prevail in an action requesting the court to have these debts ruled as non dischargeable. If it does not, then the debtor will receive a discharge of the debt.

Understanding the various nuances of bankruptcy can be difficult. To find the best options for your situation, contact a bankruptcy expert in your area.

A few times each year I am approached by new clients, in need of my services as an Orlando bankruptcy attorney, who have already filed their bankruptcy case on their own. These “pro se” debtors have filed without seeking the advice of an experienced bankruptcy attorney prior to filing bankruptcy and are normally in a tight spot, desperate to fix something that has gone wrong in their case.

Recently, I was contacted by a client who was concerned because she received a Motion to Dismiss her case for not attending the 341 Meeting of Creditors. She told me that she had been out of town on the date the meeting was scheduled and could not make it. She did not receive a Notice from the Trustee regarding a rescheduled meeting, so she missed the meeting on that date too.

After reviewing her case, I contacted her Trustee and worked everything out with the Trustee. I then fixed her bankruptcy petition so that the exemptions were properly applied and she would not lose her car.

A great deal of people seek the debt relief filing bankruptcy can provide each year, and while many of them are successful, there are many others who result in their case being Dismissed, their Discharge postponed, end up losing assets they could otherwise have kept, or make the whole experience a lot more difficult for themselves than it should be. This is due to spending a couple hours doing “research” online and coming to the conclusion that filing bankruptcy is a simple process that can easily be done without help.

But bankruptcy attorneys charge for their services, you might say. That is very true. However, in most cases, an Orlando bankruptcy attorney, like myself, will offer a payment plan to their clients. You see, when someone comes to me after filing bankruptcy on their own, I need to spend a great deal of time fixing the problems with their case. Therefore, had they hired me in the first place, they may have not had to pay as much for my services had I not had to step into an emergency situation to stop a potentially disastrous result in their case.

Hiring an experienced Orlando bankruptcy attorney who has an understanding of the local bankruptcy Court procedures and bankruptcy laws can help you avoid a very bumpy trip through the debt relief process that could result in your case being dismissed. At a minimum, having a bankruptcy attorney by your side will lessen the anxiety you feel towards the bankruptcy process in general.

To get the debt relief you need, before you try to “do it yourself” please contact an experienced Orlando bankruptcy attorney.

Creditors have to determine what kind of a risk it would be to loan you money. All debtors are a risk to creditors however it is those they view as a good risk that will ultimately get the loan. In order to reach your goal of being seen as a good risk you need to first take action to raise your credit rating. A good credit score is the best way to be seen in a good light by a creditor. Use these tips below to start increasing your credit score. Keeping your credit score high is also a great way to keep bankruptcy from becoming your reality.

1. Obtain a copy of your current credit report and evaluate your score

There are many free credit report services available today. Choose the one that best fits your needs and get that score. If you find out that your score is below 450 it is imperative that you begin working to fix your credit right away. Even if your score is 500 or below red flags will go off for creditors. Only a score of 600 and above will garner the respect of a creditor and there is still room for improvement.

2. Get a consolidation loan

When you take your current debts and consolidate them into one loan you are likely to reduce your total monthly payment. It will also make it easier to pay off these debts.

3. Pay on or before the due date each month

Once you consolidate your loans make sure you make payments on time. This will truly get your creditors attention and hopefully restore their confidence in your debt-paying ability and attitude.

4. Make bankruptcy a last resort

There is nothing worst that you can do to your credit score than file for bankruptcy. Having bankruptcy on your credit record means getting a small loan, buying a car or buying a home would be virtually out of reach. Bankruptcy stays on your credit report for 7 years and that is a very long time.

Despite your efforts it may be too late for you to avoid filing for bankruptcy. In the event that you have no other choice you’ll want a chapter 7 bankruptcy attorney working for you. Your bankruptcy attorney will be educated on the ins and outs of the law and have your best interests in mind.

For many Americans in today’s economy, a telephone call is enough to trigger that uncomfortable feeling in the pit of your stomach. The call is from another creditor looking for payment and perhaps threatening foreclosure and repossession of your car or home. It’s a scary and difficult time, but it’s also not a time to ignore the phone and your deepening financial difficulties. You probably have bankruptcy questions and that puts you in a similar situation to millions of other Americans.

You can stop those harassing phone calls that seem to multiply every single day and take actions to solve your financial crisis. The first step is to contact your bankruptcy lawyer and get some answers to your bankruptcy questions. Whether it’s a lost job, unpaid medical bills or simply the worst recession in nearly 70 years that has placed you in an unstable financial footing, it’s important to understand that you still have control of the situation.

That way you will pay a reduced or no interest rate on unsecured debt like credit cards and some loans. That will stop the collection calls and you will soon be sending in one monthly payment that is divided among all of your creditors, according to the debt relief negotiations. Perhaps debt relief can solve your situation. An expert lawyer will contact all of your debtors to negotiate settlements.

Maybe the situation is so advanced that repossession or foreclosure is imminent on a vehicle or home or other piece of property you own. Creditors and perhaps even the federal government are threatening to garnish your wages. This is not the time to give up. Instead, this is the time a bankruptcy attorney can help you dig out from even a mountain of debt and lead you to a fresh start, free from the crushing debt that has turned your life into a nightmare.

Even better, this so-called automatic stay remains in force as long as your case is in bankruptcy court. Your bankruptcy attorney will determine whether to file a Chapter 13 reorganization plan or a Chapter 7 liquidation bankruptcy. If a bankruptcy lawyer determines that individual bankruptcy is the best answer for your financial situation, the papers can be filed electronically. That triggers legal protection that blocks any of your creditors from continuing to call or take action to try to collect debts, like garnishment, foreclosure or repossession.

Your attorney will determine if your income level fits the strict requirements for Chapter 7. If not, Chapter 13 is the second bankruptcy option. Under Chapter 7, any of your unsecured debts are completely liquidated. You must continue paying on secured debts.

In Chapter 13, you can save your property by paying off what you owe, including penalties and missed payments, over time. It takes about 5 years for this to happen. The Chapter 13 budget plan also pays any discretionary money to your unsecured creditors. Any unpaid debt for unsecured creditors at the end of the plan is discharged.

The lawyer is an expert professional, who understands the intricacies involved in the various laws and regulations. Therefore, you must take care of many things while hiring a lawyer for you. You will find the following tips very useful in this regard:

Comfort Level

The bankruptcy lawyer you are hiring have the license, the next step is to make sure that you are comfortable talking with him or her on the various aspects of your bankruptcy case.
Comfort Level

You will have to make sure that the bankruptcy lawyer you are hiring has the license to handle bankruptcy cases in your state. It is very important for you to understand that the laws of bankruptcy vary from state to state. You cannot hire an attorney from some other state to handle your case, if you live in some other state and the attorney does not have the required license – no matter how much experienced he or she is. Since you are filing for bankruptcy, you are certainly not in a situation where you can afford to pay a substantial amount as attorney fee. The attorney fee must be something that could fit your budget.

How do you find the right bankruptcy lawyer? A person forced to file bankruptcy is emotionally spent and unable to deal with the necessities, filings, and handlings of a bankruptcy case. Filing bankruptcy is a scary and tedious process. It is draining and impossible to stay on top of it unless you are a bankruptcy lawyer. What are the guidelines to follow when hiring one? Here are a few tips on how to choose the right bankruptcy attorney for you.

Where do you go to find the best bankruptcy lawyer? Lawyers on the bankruptcy court panels are experts in the field adding to the confidence level you should have in him or her when selecting someone. The yellow pages do not cut it during these tragic situations, so why not contact your local attorney bar association. Call your local bar association and enquire regarding who sits on the bankruptcy court panels in your area. This will help narrow down your selection in an effective manner.

You need someone with a reputable history of success in handling it with ease. Questioning those you know in similar scenarios is a great way to find out about an attorney before hiring him or her. Unfortunately, more people have filed bankruptcy in 2010 than in past years and it shall only increase as we approach 2011. For dealing with bankruptcy is difficult and you do not want to make it worse on your family by choosing a lawyer who is not an expert in the field. Find out who has handled bankruptcy related issues amongst your relatives, friends and loved ones. Ask around your area.

What is the difference between filing for a Chapter 11, Chapter 7 or a Chapter 13? What does the lawyer need from you to get started? Ask your lawyer what are the benefits to filing for bankruptcy. How long will the process take? Who will go to court with you? What should you expect? All of these questions need to be answered before you proceed forth. Thus, find a lawyer who is able to supply information addressing these issues.

Is your lawyer affordable? Ask about Fees. Is there a written agreement? Find out what is included in the fees. Are there going to be any additional unexpected charges? If an lawyer requests for you to sign a fee agreement upfront do not be turned off by it. Have the lawyer outline worst-case scenarios; explain regarding hourly fees, and describe the charge breakdown. For many lawyers do this in the beginning as a sign of their commitment to you as their client. It is considered to show a level of seriousness he or she has about representing you.

Call courthouses where the lawyer holds court and make inquiries about him or her. Google the lawyer and discover if anything comes up. Check and see if the lawyer has any lawsuits filed against them. You are about to make a huge step in your life and you need to not only check references but research the potential lawyer for hire.

Bankruptcy is a tough situation, so make sure you find a reputable Mesa Bankruptcy Lawyer.
